Legal Question in Wills and Trusts in California

My mother died July 2, 2004. She left a Will leaving everything to my brother and I to be divided equally. My brother is on his death bed. He is the Executor. His wife of 6 months is refusing to send me a copy of my mother's Will so I can put it through probate. She is not in the Will at all.I have hired an attorney to assist me. I live in California and my brother is in Oregon where my mom died.How will my attorney be able to help me to get a copy of the Will from her? There is property and a house involved. I want to sell the house and split the money with my brother and I.

Is the property in Oregon or California? If in Oregon, you should talk to a Probate attorney there. If in California, you should petition for probate here in California and forget about the will.
