Will, Living Will or Trust
We are a married couple of 27 years with two grown children, 19 & 21. We own a home,my husband has a retirement savings, a we min 2 -5 small investments. What would you recommend that we do, a will, living will or a living trust. I was told that a will would be fine. I basically want to have something in place since all my family is back east with the exception of my sons. I would want for things to be laid as to what would happend with our estate and a health directive. Which one would be the simplest to do?

If you wish to avoid probate a revocable trust is the best approach. Springing durable powers of attorney for asset management and advance health care directives should also be prepared at the same time. Please contact me if I can be of any assistance.

A comprehensive estate planning package includes a trust, will, and both medical and financial directives. You can try to do this yourself using commercial software or forms that are available at office superstores. Or, you can contact an attorney to discuss the specifics of your situation and he/she can recommend the best way to proceed and prepare the documents for you and your husband.

The simplest thing you can do is to place your home into a living trust, which will provide for the distribution of the home after your deaths. That will help to avoid the probate system and the legal fees that come along with it. There are other things you can do as well; feel free to contact me if you would like to discuss them.
