Legal Question in Wills and Trusts in California
Will violation
Hello,
I am the appointed Executor/Trustee of my Mothers Living Trust. My sister is a 50% beneficiary of her estate opted to take several personal items of my Mohters and keeping them for herself and/or giving them away immediately after my mother passed away. She was not interested in getting a copy of the Trust and all the related documents.
Isn't this a violation of the Trust? I'd like to know what are my legal options for getting the items back and is prosecuting her an option?
Could this also be considered an indirect contest of her Will?

Re: Will violation
it is not clear from your question whether your mother's estate passed by will or by trust. are you the executor of her will or the trustee of her trust - or both? were all assets titled in the name of the trust? in any case you will need to retain an attorney to assist you with administration of the will (probate may be required) or trust and particularly if you decide to take any action against your sister.
