Re: Wills

Wills are rarely ever registered, and are therefore not publicly available until the person dies. The simplist answer is to ask him for a copy. If circumstances do not permit such a questions, then you can rest assured that in California, you have a community property interest in assets of the marriage. Community property are things like the house you bought during marriage and used income from him and/or you to pay the mortgage. Your husband has complete control over his 1/2 interest in community property, and he cannot transfer your 1/2 interest absent your consent. If your residence is community property, it cannot be sold without your consent. Any attempt is voidable by you. A title company would never provide a title policy without your signature.
