Wills and Stolen Inheritence

A will was written by mother that didn't leave too many specifics. It states that all her possessions were to be split evenly. A brother was able to get hold of money that was in a bank account of my mother's that wasn't stated in the will, but was assumed to be divided among other siblings. This brother stole this money and has used it for personal reasons and is unwilling to give any of it back, even though he has enough to pay us all now. In addition, he lives with his wife in my mother's house and is logging ''unverifiable hours'' on alleged repairs to the house. What is my recourse in this matter?

Thanks for your posting.

If the case is still in probate court, you should challenge the case in court, and bring your brother's actions before the court.

Otherwise, you have the right to sue your brother for your damages (i.e. your losses due to his conduct) that are attributable to him.
