Legal Question in Wills and Trusts in California

Wrong person using funds from trust.

My grandmother has a living trust where her accountant and my mother (her daughter) are responsible for handeling the funds. My mother has been in charge of paying the bills as my grandmother is in a nursing home with dimensia. Now my mother is also in a nursing home with brain cancer and her husband who specifically was banned from having any control over her money is now using the funds for his own personal use. I nor my siblings have no idea how to contact the accountant and need to know how we can stop him from acessing my gandmother's money.

Re: Wrong person using funds from trust.

There should be a successor trustee appointed in the trust in the event your mother is unable to act. If there is not a specific person named, the trust should name how to appoint another successor trustee. If that is the case ask the court for intervention in appointing a new successor trustee to handle your grandmother's estate
