Legal Question in Workers Comp in California
on 9/30/08 I had fall at work. I slip on the wet kitchen foor and fell back and hit the back of my lower left side of my head. Now, i've been having burning sensation, headache. I end up having to go see a chronic pain and accupunture and phy. therapy, physiatric, neurology which they had perform botox inj. on my head and occipital inj also and none help relief my pain. Now, i have on going pain on the back of my head. I had reach my maxium treatment and I was put down for 5% disability. I do not have a lawyer and they are offering me $16,000 total. I did not accept that. I know that i deserve more then that. my mri is negative. How much do you think i should ask for?

While I often do not say this,as a former WC insurance attorney, i thnk ;you need to find a good WC employee's attorney. It sounds as though no one has diagnosised what the injury is nor taken into account what your work limitations are. On a normal 5% PD back injury case, $16,000 would be a generous offer, but it may not be in your case. Without reviewing your medical records and speaking to you, none of us have any idea what your case woud be worth. An attorney would get an award of 9-12% of the permanent disability; it is worthwhile to pay that sum to determine what is physically wrong with you and what your case is worth.
