Legal Question in Workers Comp in California
I was off 5 mos, out of my control with therapies, surgery and healing. Can they lower my status from full time to per diem (less than part time) and take away my benfits even though I returned with no restrictions or limitations?

No. The employer must offer either a regular or modified position for one year that pays at least 85 percent of the previous wage. Benefits can be added into the wage caluclation.
At this point I suggest you find an attorney, a civil attorney possibly, and discuss a potential 132a discrimination claim.
