Legal Question in Workers Comp in California

AME decision not being adhered to

AME ruled cervical spine injury 100% work related and granted future medical by orthopedic or neurosurgeon. Diagnosed in Mar 2004. City keeps denying any and all prescribed treatment by my orthopedic surgeon. Therapy, cervical injections, referral for consultation - all denied. I thought the AME's report governed my future medical. To date I have not had any treatment for cervical spine injury. (Had to buy my own cervical collar!)

You need to file an application for adjudication to get a hearing, and perhaps an application for expedited hearing if the injury has not been deemed permanent and stationary. Why?

You need to speak to your attorney right away and request he address the medical treatment issue in an expdeited hearing. I would consider filing a penalty petion un LC 5814 as well.
