Legal Question in Workers Comp in California
I saw an AME in May 2008. It is not January 2011 and I am scheduled to see the same AME in April 2011. The AME agreed with my primary doctor's findings in his first 3 reports. I was asked to see a doctor friend of his who treated my badly and handled me roughly. I then was asked to see a Occupational Therapist (4) until see refused to return. I then was asked to see an alternate Work Therapist to completely evaluate me one last time. He did not do a complete eval. The attorney for the defense started asking questions regarding my home care which was 20 hrs. a week. When the AME submitted his report the attorney asked another question like when did his home care need start, what did he need home care for, it would be best if I got a specialist in my town. My home care was agreed upon by the AME, then he said I did not need home care, and now he says only 2 hrs. a week. I was told the AME has the last word and it must be obeyed. Yet, when the AME agreed with me, the defense would not comply. What can be done? Has anyone every heard of an AME taking 3 years to do a job. I feel a pay off is at hand. I am owed over $40,000. My home care provider is dying because of a mouth disease and both the defense attorney and the claim adjuster knew and both refuse to pay. I asked for my money for a attorney for a crime I did not commit and the adjuster would not send my money and I may go to prison when I would have been found not guilty if I retained an attorney. She wanted me to go to prison. The AME has gotten involved in events that has nothing, I believe to do with what he was to do.
