Legal Question in Workers Comp in California

Ankle injury question

I have an ankle injury from a work incident back in 2005. I was ''cleared'' from the Dr. in 7/2006. After any activity of strenuous standing or moving, I limp for about a day afterwards. I have not sustained any other injury. Am I entitled to any compensation for the discomfort I'm having in this ankle?

Re: Ankle injury question

You need to be examined by either AME (Agreed Medical Examiner) or a QME (Qualified Medical Examiner) and then your disability will be rated for determination of the permanent disability and your compensation will be based on the rating, need of future treatment and need of vocational rehabilitation. Re: Ankle injury question

You are entitled to compensation for the percentage of disability in your ankle, and leg, and any other related issues (e.g. back). The amount of money is derived from charts which begin with a doctor's description of the limitations caused by the injury. Factors, including the type of work you perform, and your age, are then included in a "money chart" to come up with a figure to be paid. In addition, you are entitled to medical treatment for the injury, and, if you are unable to work, some type of vocational rehabilitation. The insurance company will many times dispute that you are entitled to an award, and it makes sense to be represented by an attorney. Good luck.
