Legal Question in Workers Comp in California
approval process
My husband got a hernia at work from lifting. He has now had surgery 7/26 he is suppose to return to work on 8/17. The problem is that he is having alot of pain and he has explain this to the Dr. and the doctor does not understand why. The doctor has order a CAT scan on the area and we are waiting for approval from Workmens comp. The doctor has told us that they ask for a rush on the request but we have not heard anything for 6 days. My husband is in pain and just staying in bed. By law how long do the workman's comp have to take for the approval process? I have been calling the workman's comp insurance I keep getting the run around. The Dr office just says its in the hands of the workman comp. Does it usally take this long to get approval on something right after surgery?

Most insurance companies are reluctant to cover necessary treatment and either delay or refuse to authorize them. Your husband needs an attorney to protect your rights. He probably needs to change his insurance-appointed doctor. Call us at 213.388.7070 for a free consultation.

Quit practicing law without a license and get representation. The carrier has 14 days from the request to approve or deny treatment, absent an objection pursuant to LC 4062, in which case the carrier has 27 days.
If approval is not forthcoming file for an expedited hearing.
Lastly, if you do not like the doctor, request a change in physicians.
