Legal Question in Workers Comp in California
I don't believe my attorney is doing a very good job. I have many questions regarding my case.
i have left numerous messages with him and his personal secretary,
i have yet not got one return phone call in two years. Can i fire my attorney and hire a new one? and if so how do I go about this whole ordeal?

You have the right to fire your attorney and hire a new one. There are two ways to go about this. 1. You can file a Notice of Dismissal with the Workers' Compensation Appeals Board indicating that you will proceed on your own until you hire another attorney. Once you hire another attorney, he or she will file a Notice of Representation. 2. You hire an attorney first. Then he or she files a Notice of Substitution of Attorney with the WCAB, indicating that he or she is replacing your current attorney.
You can locate another attorney in your area by going to the website for the California Applicants' Attorneys Association at www.caaa.org. Good luck!
