Legal Question in Workers Comp in California
Automobile accident while going to work on call.
I wanted to pls find out that my wife had a bad accident on 405N while she was responding to her work being on call.She is a Scrub tech and works in the operating room.Would this be a workman comp case pls advise us, what to do she was in the hospital for 4 days.Thank you.

This certainly could be a workers' compensation matter. The defense will definitely raise the "Going and Coming Rule" This can be problematic since your wife was only "on her way" to work. However, given the contract your wife has with the Hospital/doctor, and other facts, there may be a way to overcome the G.A.C.R. In addition, there may also be others responsible for your wife's injury.
