Legal Question in Workers Comp in California

I was awarded a judgement a couple of years ago and I now I have asked my lawyer about 5 months ago to see what kind of cash settlement I can get at this point. My Attorney is not very helpfull and when I call him he never returns my call. I Had to send him a letter and then he finally had one of his people call me and she was very nasty & rude. Can you tell me if I can change Attorneys with out paying this person. I also need to know how long it takes to find out how much the employer is willing to settle for. Iris Maxwell

you can always dismiss and attorney and represent yourself. If everything is settled out but future medical, it should not be too difficult with help from the information and assistance office to settle by compromise and release

If you had an award of permanent disability, the attorney fees would have already been taken out of that sum. The Board must approve a commutation of the PD award; you need to show good cause beyond just wanting to have the money in a lump sum. I would recommend against settling the future medical treatment award.

I will be glad to review your case to see whether or not we can enter into a Compromise and Release to settle out your future medical and your P.D. Please call me at 1.877.505.INJURY for a free consultation.
