probably not with respect to suing the employer. However, you may want to file a comp claim with an attorney and speak with a Personal injury attorney concerning wilful misconduct. If you find one who practices both, you might save some time.

Most likely the answer is you can't file a civil lawsuit against your employer on these facts. You can pursue a worker's Compensation Application and claim (lawsuit) against the employer and you are entitled to receive medical care, temporary disability, permanent disability and vocational rehabilitation paid by worker's compensation insurance carriar. call us at 213.388.7070 for a free consultation.
