Legal Question in Workers Comp in California

Back Injury on the Job 8yrs ago

I received a back injury between L4 & 5 & the whole right side about 8 years ago. My Dr only wants to perform surgery which will make my mobility impossible. I am 77% disabled, with life time medical. I do work and I know my limitations and am very careful about what I do. Now the insurance company wants to settle out the life time medical and I have been under treatment/therapy on my own, which keeps me mobil, because my Dr won't authorize it because he just wants to cut. DO I get the original Ins company to pay for it or settle out? And My attorney wants to settle for nothing. What can I do?

I can understand not wanting to undergo surgery. Back surgery is often a crap shoot. The results depend on phases of the moon. At this point my suggestion would be to change physicians to someone more in sync. with your views. Many of my clients swear by non-traditional treatments. I have surgical patients who see a chiropractor and manage to cope without surgery.

Get a physician who recognizes that exercise and non-traditional therapies seem to be working for you. If you went to a restaurant that served crappy food, you would go somewhere else. I suggest you do the same with your physician. However, if the new physician says decisively that you must have surgery, then you might reconsider.
