Legal Question in Workers Comp in California

back injury required surgery

I recently had my third back surgery. The last two injuries were a result of lifting while in the field at work. (Dated 5/05 and 1/07)I was told to not file a claim as I would continue to be paid my bonus for the month of 5/05. The most recent inncodent was much more severe. I filed a WC claim only to be denied. I have two witness statements and in fact it was my client who called 911. I have not yet been released back to work and don't anticipate it anytime soon.

The insurance companies routinely deny workers compensation claims. You need to have an attorney represent you so that you can file a claim with the Workers Compensation Appeals Board -- your injury is severe, and you should have an attorney representing you so that you can obtain as much as possible from the insurance company. Feel free to respond to my private email. Good luck.

You have not posed any question! What is it that you want answered? Who told you not to file a claim and what negative effects arose from that? What reason was given by the WC Judge in denying that your injury was work related and what was the decision as to the 2005 injury. Any Dr.'s say what caused the need for surgery. What was the diagnosis for both injuries. Do you have a WC attorney representing you and have you asked him your questions and what did he/she say?

The previous two attorneys failed to note that you did not ask a question. I suppose they just wanted to say something. Hopefully it was what you needed to know.
