Legal Question in Workers Comp in California
Basically, I had to have surgery that was approved by workman's comp because it was related to the loss of my finger. Two months after the surgery they decided not to pay for the surgery center because they said the surgery was not related, however they did pay the surgeon, physical therapy,medication etc... I contacted my attorney several times and after a few weeks he decided that workman's comp was not resposible for the payment ? My attorney ! I have since left several messages for this so called attorney to see what he is thinking but have yet to hear from him, Its been a month. What can i do? can i hold my attorney legally responsible for the financial impact this has had and will continue to have on me? can i find an attorney that is good and settle this case that has been ongoing for Ten years. i did have a good attorney before this one, but he retired...

E-mail your attorney, since he will not respond to your messages so probably will not speak to you over the phone, that you relied to your detriment, as the carrier knew you would, in having the surgery that they approved so they should be responsible for the bills as you would not have had the surgery had it not been for their saying they would pay for it. he needs to tel them that they are legally required to pay all the bills and that if they do not he will file a petition to impose sanctions for failure to pay for the medical bills. Also, demand that he show you a strategy as to how he will handle the rest of your case. Tell him that the failure to respond to your numerous messages and to raise the issue of non-payment of the medical bills is improper and unless he changes you will have to consider changing attorneys.
