Legal Question in Workers Comp in California

Can your boss' insurance claim ppl deliberately 'not' return calls and ignore th

Can the insurance claim person just decide to ignore calls from you? I was told they wouldn't make a decision on accepting/denying my claim for 3 months, that 3 months is up, but I have yet to hear anything and they won't call me back. They called my Dr and asked about my work status, but refused to return my calls. What do I do. I need an auth for a second oppinion/therapy and need to find out if my claim is accepted or not. I didn't want to hire an attorney, but I fear I may have to. This is very painful and stressful...please help.

Re: Can your boss' insurance claim ppl deliberately 'not' return calls and ignor

If it has been over 3 months since you filed your claim and the carrier has not issued a notice of their decision then this will operate as an admission of the claim under the law. You are allowed to change your physician after the first 30 days after the injury if you have not been released from care. If your injury is serious and you continue to be ignored as you have been already in degradation of your person and your rights then I would contact a local attorney.
