Legal Question in Workers Comp in California
if i broke my toeat work and did not finish my shift due to the injury. but instead went home and the next went to the hospital can i still file a workers comp claim do the fact my employer said go to the hospital and i didnt go till the next day.

Certainly you can file. Yu do not have to obey your employer's recommendation as to medlcal treatment [especially if he has no real lmedical knowledge]. At most your doing something wrong might reduce a particular benefit but it does not eliminate your rlights to file.
You need to report your injury immediately to your supervisor and if you can't continue working, the doctor should take you off work , and if he is unwilling to do that and you can't work, you may need to change your doctor. Feel free to call us at 213.388.7070 for a free consultation.
