Legal Question in Workers Comp in California
I have a broken left foot and I am in a splint. My employer wants me on modified duty. I have restrictions which require me to be off my foot. Such as elevate, no walking, no weight. Also no Stairs. At my house I have 30 steps going up to my front door landing. My question is. Do I have to traverse these stairs to go to work because the company wants me on modified duty? I feel it is A.M.A..

First of all, did you tell your doctor about the stairs? If not, advise him or her as soon as possible and get a note indicating that you are unable to travel to and from work as a result. Make sure it specifically mentions the stairs. In the meantime, it is best to go to work for modified duty. You may be jeopardizing your job if you fail to do so and the doctor has not given you a note.
