Legal Question in Workers Comp in California
CA. workers comp holding back needed medication
California Work Comp - My case has been setteled for many years. Because of my neck and back injuries I have constant pain and require narcotics for control and to function.
New adjuster all of a sudden after 10 years is dening meds and am suffering terribly and can not take care of myself. Adjuster will not accept communication from me.
Paralegal from attorney's office says to pay for meds myself and then the attorneys office will sue work comp for reimbursement. Everyone else: previous attorney's in the office, current doctors and pharmacists are saying not to do this. I am at a loss as to what to do, hard to think right through the pain.
Any help appreciated.

Have your attorney set a hearing to have the judge order payment.

don't pay. File for an expedited hearing on the treatment issue. Only a licensed physician can deny, modify, or prescribe treatment. If the adjuster has no medical report as a basis to stop your medication, then the carrier will be assessed a penalty if you are successful in the expedited hearing.
