Legal Question in Workers Comp in California
California WC
I was assaulted at work by a contracted security guard in 6/07. I was out for 3 months returned with modifed hours. Doc took me off work again in 1/08 due to stress related issues with my employer. This time for 6 weeks. I am returning with the same restrictions. I have been employed by this company for 16 years, however the company was bought out in 8/07. Can my employer terminate me while on WC and offer a severance package? I have read that this is possible. Advise.

Re: California WC
Don't agree and sign any severance package that include any release of liability. I have seen this trick by many employers who offer a severance package and have the employee sign a release of all liabilities. It seems to me that you have a valid worker's Compensation case and you need to be represented by an experienced worker's Compensation attorney. Another important thing is you have valid and strong stress case against your employer due to the assault. Please call us at 213.388.7070 for a free consultation about your case.
