california work comp law, how to repeal?

I am an injured worker. I had no idea my right to sue my employer was taken away in 2004. 2/08 injury, result very large cervical herniation c6-c7 with severe spinal cord compression and damage (MD told me if I fall before the surgery or any neck injury I will likely become a quadraplegic) I an RN made very good money (worked extra shifts all the time) the pain is unbearable the quality of my life diminished and the loss of income massive. Yet I have no recourse??!!! I want to know how to go about challenging the constitutionality of CA work comp law (many areas of concern for me, one of which is I do not have equal protection under the law) and perhaps a class action with other injured workers. Is this a possibilty or just an unrealistic hope?

Your right to sue your employer has not been taken away. You can still get compensation for your permanent injuries(not as much as pre-2005) for your work-related injuries. If you need representation to persue your worker's compensation claim, call us at 213.388.7070.
