Legal Question in Workers Comp in California

California Workers Comp

I am hurt 3 derniated disc in my back, been told I need surgery, however the doctor and worker carrier can't agree which surgery I should have. It has been over a year, I am in a lo of pain. Do I have another recourse, ie personal injury or e & o, due to the carriers lack of response.

I need more information to be able to help you. General rule is if you get hurt at work, the employer or its insurance carrier are required to provide medical treatment, temporary disability, permamnent disability and Vocational Rehabilitation. However, if you need an expensive procedure or surgery, they will send you to their own doctors to document that your injuries are either not work-related or were pre-existing or many other excuses to refuse to pay for it.
