Car Accident Victim
I was in a coworker's car during a business trip and while we were at a complete stop, we were rear-ended by another car. Additionally, I had back sugery back in December and was recovering nicely. Since the accident last week, my back is worse than before my surgery. The person that crashed into us was in her company car insured by her business' insurance. Should I get representation under my Worker's Comp. or against the driver that hit me so that I don't incur massive medical bills, assuming I need surgery again.

You have to do both for various compensations. You can file a worker's compensation claim to receive immediate medical care including the aggravation of your pre-existing back condition and you are entitled to temporary disability benefits while treating, a settlement for permanent disability and vocational rehabilitation. You also should file a personal injury claim (as a third party claim) against the other driver and you will be entitled to a settlement for pain and suffering.
