Legal Question in Workers Comp in California

I had a case back in 99 in Calif I had pronator teres syndrome anyway I had surgery and it fixed the problem. So now the problem has come back my current doctor and nurologist have decided i'm having problem now because of the scar tissue from the surgery i had in 99. So my doctors want to go back and file a claim against the old workmans comp carrier its been a year since we filed a claim with them and they just got back to me on 12/1/10 saying they want me to see one of their doctors and if he agrees with my doctor then they will pay for the surgery but will not pay me for lost time. It took them a year to get back to me I would think they should at least compensate for that time. thank you for your help.

The WC laws cut off wage loss benefits after 240 weeks. You also can not claim an increase in permanent disability. You can seek to get a penalty against them.
