Legal Question in Workers Comp in California

how much is my case worth

I am not legaly represented in neck injury case of 2002, reinjured 2003. Two years ago case was worth $54,000. now only $7,000. why is it if I have additional PD. At one time Defense offered $17,000, recently $20,000 to close out the case. I have decided not to close out my case, but since 2002 insurance denies any treatment, unless I go in front of WC judge, insurance approves much needed medical treatment. Please advice as I don't know what to do anymore with Defense and or insurance co.

Re: how much is my case worth

At this point, one of the cases should be settled with open medical, thus any delay in treatment can be the subject of a penalty petition where an attorney can ask the court to award fees for enforcement of your stipulations. Alternatively, you can file the petitions and seek a 25% premium on any medical treatment requested. However, the dates of injury are now over five years old so the courts will be modest in awarding treatment.
