Legal Question in Workers Comp in California
change PTP after rating?
I am currently NOT represented by an attorney. In 2 weeks I will be meeting with my PTP (recommended by WC Insurance Co.) for my PS rating. If I disagree with the rating, am I allowed to find another Dr. for another opinion? How do I go about finding a ''neutral'' Dr.? Or do I have to find legal representation in order to change Dr.'s? Is it true that once rated, changing Dr.'s outside the Insurance Co. roster is prohibited? How do I get the most FAIR rating?

Re: change PTP after rating?
You have to object to your own doctor's P&S Report, then request a AME (Agreed Medical Evaluation) and if the defense does not agree, then you go to your own QME, and so on and so on.
It is probably in your best interest to hire an attorney as quickly as possible. Feel free to contact my office for a free consultation at 818.385.0520.
Re: change PTP after rating?
QME's are generally biased toward the party whom hired them. Therefore, If you have a QME report from an Insurance Company doctor, I would not be surprised if his rating turns out to be very low and in some instances zero. I would recommend AME instead of a QME and I only use doctors that I know by experience to be neutral and fair. There is no magic list. Call me at 213.388.7070 for a free consultation.
