Changing Attorney's

I currently have a lawyer for an existing

workers comp. case. I want to change

attorney's. If I change attorney's do I have

to give a portion of my settlement to the

old lawyer.

No. Assuming that the attorneys fee is 15%, this amount will have to be divided amongst the lawyers. No impact on your portion of the settlement.

Yes, based upon the time and effort the old lawyer put into your case. Quantum meritum. However, it will not affet the 12% cap on attorney fees.

By law, the statutory rate for attorney's fee is about 15%. This fee is deducted when your case is settled and is deducted from the permamnent disability settlement. If you change your attorney both old and new attorney have to divide the attorney's between them and is normally divided for the amount of legal work each attorney completed.
