Legal Question in Workers Comp in California

Claim time limit

My husband suffered a ''groin pull'' on a construction job site. He notified his employer and went to see our family doctor. No claims forms were filled out. The doctor said it was probably just a strain but now, some 10 months later it is still hurting him and we think it may be a hernia. Our question is, has too much time passed and also, he is no longer employed with the same construction firm, can he still make a claim? Thanks

Your husband needs to see a doctor, and he also needs an attorney to represent his interst. It sounds like he has a hernia. Without an attorney, good luck getting the employer to pay.

Yes, a claim can still be file without issue within one year of the date of injury. I recommend you speak to the information and assistance office fairly soon to get the paperwork before the WCAB.
