Legal Question in Workers Comp in California

Continuing Medical Benefits While Disabled

I am in the middle of a Work Comp Investigation. Since I am disabled because of an injury (Carpal tunnel & Thoracic Outlet) that happened at my job, does Work Comp have to pay for my benefits (health, personal disability) while I am disabled? Thank you.

Re: Continuing Medical Benefits While Disabled

It seems from your question that you are currently in the period commonly referred to as the "delay" period wherein the carrier is making the decision to accept or deny the claim. It is not clear from your message however as to what your status is medically. As you have a diagnosis it seems logical that you have been to a doctor. If the doctor has determined that you are unable to work (temporarily disabled) and in need of treatment at this time then you should receive temporary disability benefits. Further your medical treatment should also be paid. If you have received this medical determination from a physician and that physician has related your injury to your work and you are not receiving benefits still then your best bet is to contact an attorney to assist you right away.
