Legal Question in Workers Comp in California

credibility problem

Our lawyer says that because the truth was not told there is a credibility issue, there was a very good reason for not telling the truth that day, having three kids to support and looking into the faces of many co-workers who will lose their job.

hoo boy... I'll try to make this brief. My husband was injured on job by a grinder that slipped out of hand and bounced off concrete co-worker was told to run and get the safety cover from the tool storage, and attach it before the inspector arrived or the job would be immediately shut down. Was asked to lie and say cover was on grinder, all would have lost their job that day if the truth was told.

Got stitches, and returned to work same day, a few weeks later cut got infected, and required surgery. Received layoff notice while re-covering in hospital.

Later required a second surgery, and obtained a lawyer. doctor says knee will never be the same, and vocational rehab is allowed.

Today we received a letter from the lawyer telling us we are being handed over to a different attorney. Now what?.. oh and incidentally due to the bad knee giving out now the other foot got broken due to a fall.

Credibility is not the problem. To have the broken foot covered as an industrial injury may be the issue. Negligence is not required for compensation in a work injury. The fact that your husband was passed off to another attorney not of his chosing may be a concern. Be sure that he is comfortable with whoever is representing him.
