Legal Question in Workers Comp in California
My dad is a resident in California but is a long haul truck driver and has been for over 20 years. Last week while he was over the road he had a stroke in Louisiana. The stroke messed the top part of his brain up which left him with poor motor skills. He will not be able to return to work doing the long haul truck driving. Can he claim Workers Compensation benefits?

He can claim benefits under worker's compensation if his stroke was partially caused by his work. He can still receive disability under state disability but it takes an expert opinion in a form of Agreed medical examiner or qualified medical examiner to determine the cause of his stroke.
