Legal Question in Workers Comp in California

My daughter was off of work due to carpel tunnel injury on 7/13/09. She never received workmans comp pay or benefits the whole time she was off and was not released to go back to full duty until 10/9/09. She just received notice from her employers workmans comp ins that her claim was denied. Is that legal? How can I not be paid for an injury that was caused by my job?

It is perfectly legal for an employer to deny a claim. This is why injured workers should at least consult with a workers' compensation attorney. Please feel free to contact my office at 1.877.505.INJURY to set up a free consultation.

It is very common that claim adjusters deny a claim for very trivial and rather stupid reasons. A denied claim does not mean that there is no legal basis for that claim. It only means that there may be a very biased interpretation of the claim by the claim adjuster to find an excuse to deny paying any benefits. I highly recommend that you retain an experienced worker's compensation attorney who is familiar with all these games. Feel free to call us at 213.388.7070 for a free consultation.
