Legal Question in Workers Comp in California

demand letter for payment

I had a case manager send a letter with a proposed settlement back in 11/06 He said to sing it if I agreed to the offer and fax it back to him, so I did in 12/06 I called serveral times and he said that he couldn't give me a time when the claim would be paid. I'd like to know what the law is on this matter (of time) that the claim should be paid. Thank You.

Re: demand letter for payment

The claim should be paid within thirty days from the date the agreement is approved by the judge. In this instance it appears you need to file for a hearing so the judge can review the settlment and approve it.
