Legal Question in Workers Comp in California

Denied State Disablilty

Just recieved my determination letter from Ca. State Disability. I am going to appeal the determination. How long do I have to wail for a hearing and will I be able to collect benefits? I am scheduled for an operation June 19th. I have a Workers Comp case that has been pending for over a year now. They are dragging their feet...I have NO benefits of any kind at the moment. Help!!!!

Re: Denied State Disablilty

Why were you denied state disability? Did you point out that you have also been denied WC benefits? Their Board can better tell you what the waiting period for a hearing is in your area. Are you represented by an attorney for WC? It does not take a year to get a hearing, especially when injury is in issue. If you do not have a WC attorney you apparently need to get one immediately.

Re: Denied State Disablilty

If your case denied, you can request for an expedited AOE/COE hearing and it normally takes about 1-2 months to get the hearing. From your zip code 90016, I think you are very close to my office. Feel free to call me at 213.388.7070 for a free consultation.
