who determines the amount your attourney gets paid

The judge of the Workers' Comp. Appeals Board who hears your case. Iam not sure if the range is still 9% to 12% of the permanent disability awared. The difficulty of the case is supposed to determine the attorney fee pecentage, but normally it is what the attorney requests.
