Legal Question in Workers Comp in California
I have diagnosed with CTS and its work related been going through this since 2012. I have had left and right hand carpal tunnel release surgeries, I now have issues with my right elbow up my arm into my neck.... I ha w been seeing the same ortho but I'm getting to the point where I think I should get a lawyer. I got relief from the surgeries but I can't keep doing the same work. I'm in grounds maintenance in parks for LA County. I just don't think everything is on the up and up. I was only compensated one time for being off work 30 plus days related to my injuries a year or so later after second surgery. And once the insurance company tried to close me out at 100% and the Worker Comp judge said no and caught a bunch of fishy things going on. What should I do?

Your employer or the worker's compensation carrier can't just simply close your case. You need to file an application for worker's compensation benefits that cover all body parts and the next step would be a Panel Qualified Medical Examination (PQME) which determines the extent of your permanent disability, whether you should be working or should be on disability and future medical treatment that you need. The PQME report also describes restriction that you have performing your job. The PQME doctor really decides your case and you really need a professional attorney to choose this doctor or get the defense to agree on Agreed Medical Examination which is better for you.
