Legal Question in Workers Comp in California
one Dr P$S me in 2010 The QME DR said im still TD but I was hurt in 2008 I cant get any money for TD .its all gone so does the workers comp company have to reinstate the advance they been paying me ? OME DR said I still need treatment and my lawyer wont return my calls im afraid if i get a new lawyer it will delay things been waiting over 3years

Based on the facts that you have given, you are only entitled to 104 weeks of temporary disability benefits, total. Once a physician says you are permanent and stationary, the insurance company only has to pay permanent disability advances based on a reasonable estimate of your permanent disability.
You may wish to apply for State Disability Insurance benefits from the Employment Development Department. Just make sure you tell them that you have a work-related injury. You can also apply for Social Security Disability.
