Legal Question in Workers Comp in California
Employee Benefits While Out on Workers' Comp
I recently was hurt at work and my employer is unable to accomodate me so I am on disability through the worker's compensation people. My employer informed me that they will be dropping me from their medical plan until I am back to work because I am not working enough days to qualify for coverage every month. I expect to be back in two months but my family can't go without health insurance for that long. Is there a law that says my employer must pay my health insurance premiums when I can't work because I was hurt working for them?

Not to my knowledge. However, many plans offer supplemental coverage that will pay these costs when you are injured. You should review the insurance plan materials you signed when you chose your health insurance. Further, some employment contracts contain provisions regarding medical benefits. Typically, though, most of my clients end up paying the premium direclty to keep coverage while not working.
