Legal Question in Workers Comp in California
An employee filed for workers comp for pulled muscles. He's been off for 4 months. We have not received any paperwork from doctor stating he should be off work. His there paperwork I need to mail to the employee to have the doctor fill out. Similar to FMLA paperwork?

Your workers' comp. insurance carrier should be handling all of that; if you are self-insured, you need someone on staff or an available consultant who has knowledge of the system as it can be very costly,especially if you make mistakes such as allowing someone to be off for 4 months without a medical report and just pulled muscles which should heal within a few weeks or less. You probably have already paid over $3,000 in T.D.benefits.
