Legal Question in Workers Comp in California

Is Employer Exempt from Workers Compensation?

We are a very small non-profit religious 401c3. We pay very small living wage stipends to our four resident staff members (avg. $50 week). We pay for all four members health insurance coverage. Are we required to also carry worker's compensation? If so, are there any exclusions or exemptions that might apply for us to opt out as the cost would be a significant burden. Thank you.

In this case I suggest that you contact the small business administration. I do not believe you will be found exempt from liability for california workers compensation benefits. However, I am not an attorney fluent with non-profit corporations.

There is nothing worse for an employer than to have an employee injure him/herself while acting within the scope and course of his position. Churches and other non-profit agencies are not exempt from having employees injure themselves nor are they exempt from the requirement to purchase workers comp insurance.
