Legal Question in Workers Comp in California
I am an employer that has received notice to appear at an employee's workman's comp status conference. What is involved at this conference?
1 Answer from Attorneys
The injured worker's lawyer and the comp insurer's lawyer meet to speak with the judge about a problem they can't solve informally, just to see if there's a way to solve the one issue without an full-blown trial. the injured worker waits in the injured worker waiting area, and the representatives go to the judge's courtroom, sign on the Appearance Sheet, and show one another why their 'proof' for their position is better.
If you have workers Compensation insurance and there is no S&W Petition nor any LC 132a petition personally served on you, you need not apear --- your insurer has this covered for you. IF the injured worker or the attorney have served you with a Petition for Serious & Willful Misconduct of the Employer, or you've received a Petition for INcreased Benefits pursuant to Labor Code 132a, you or your lawyer should appear.
