Employer willful refusal to process Injury claim

when an employer refuses to provide a claim form when he knows that you are injured, and when he recieves recieves the claim form, refuses to provide medical treatment, or process the claim form to the insurance company. Can this be construed as a ''willful failure by an employer to secure the payment of compensation'' because of his Knowledge of the injury, and his attempt of hiding this fact from the insurance company?
