Legal Question in Workers Comp in California

employer had no workers comp

While working on new construction of a residence, I fell from a second story deck. The owner of the house, who paid me by check or cash does not have workers compensation. The hospital bills are already over 200,000.00, and it is expected that it will be six months total before I can even think of walking on both legs. Does the fact that he not have WC make him automatically responsible for my hospital bills and such? I am 60 years old. The injuries included two crushed ankles which required four plates-two each. I also tore my right rotator cuff (I'm right handed). The Doctor cant do anything about it until my ankles are healed, or he's sure I will be able to pay. I have no assets and very little cash. What will happen to my employer if medi-cal pays? Am I entitled to compensation for my pain and suffering, and for how it has affected my loved ones? How do you calculate ones own responsibility? What if I cant work much when I do heal? What kind of lawyer would handle a case like this one?

You are in a world of hurt. To give you a very direct answer to your question, you need a workers' compensation attorney, and you need one very fast. There may also be a third party case as well. I do not think it is a good idea to delay meeting with an attorney one more day. I am a workers' compensation attorney and I will be glad to give you a free consultation.
