Legal Question in Workers Comp in California

my employers new insurance co. is taking over 4 months to respond to my request for a new dr, Meanwhile I get no money from state and still am in pain. My attorney says hes doing all he can. What do i do?

Unless your employer is a state agency, the money your received is from a Workers' Compensation Insurance company [some state agencies use State Compensation Insurance Fund to adjust their claims and make the payments]. Are you collecting state disability or industrial injury/on the job injury beneflits?

You need to ask your attorney what right you have to a new Dr., can you see one of your own selection, why are no benfits being paid and what must occur for benefits to be paid, has he called up the Comp. carrier and demanded they provide a new Dr. or he will make a complaint with to the state insurance commissioner and file for a penalty [can he legally do that], what precisely has he done to get the new Dr, provide you copies of any e-mails or letters he has sent to the carrier about that.
