Legal Question in Workers Comp in California

employers witholding and/or being dishonest

I recently filed a comp claim for stress due to being harrassed for the past 2 yrs. Management was aware of this problem and demoted the accused from management. My former manager was than moved to an audit team which reviewed my files. He had been caught altering my files by two mgrs. The harrassment continued and I had a breakdown. I became afraid to work becuase of what he might do next. The comp carrier had an investigator meet with me and I provided him a list of 24 witness to the ongoing abuse. He failed to interview these witnesses and only interviewed the accused and management. Mgt denied any wrong doing and also being aware of the situation. I then provided emails to mgt. regarding these issues and from the witnesses to support my alleg. Mgt also advised the other witness not to provide any information. The mgt group is now alledging that I was an employee with quality of work issues but, I had never been formally notified me of this. I also have emails from mgt and coorporate congratulating me of my outstanding achievements along with stating that I was an exceptional employee. The comp carrier disregarded any witnesses and only used the statements of management. What do I do at this point?

Don't ever rely on someone else's lawyer or insurance company for legal advice. They are against you. Get your own lawyer.
