Legal Question in Workers Comp in California

Employers with no Workers Comp insurance

I work for a company which

services boilers for hotels and

doesn't have WC insurance. If I

get hurt on a hotel property do I

have the right to file a claim against

the hotel's WC policy? If not, what

are my alternatives?

It is illegal for your employer not to have workers' compensation insurance, and servicing boilers is a very dangerous job. If you are injured while at work and your employer is not insured, then your medical treatment should be paid by the Uninsured Employer's Fund. Unfortunately for your employer, they will have to reimburse the State, plus there may be some other penalties imposed.

You have to file a claim with UEBTFF (uninsured employers benefits trust fund). You have to make sure your employer has no WC insurance. There are different ways of checking that. Call us at 213.388.7070 if you are indeed sustain a work-related injury.
